International environmental laws : controlling transboundary atmospheric pollution in Southeast Asia
Global warming is currently one of the most threatening environmental problems facing the world. Although uncertainty surrounding this issue remains high, the United Nations (UN), based on the precautionary principle, has concluded the 1985 Vienna Convention for the Protection of the Ozone Layer (hereinafter referred to as the Ozone Convention), the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer, and the 1992 United Nations Framework Convention on Climate Change. ASEAN has not undertaken significant efforts to implement the Ozone Convention and the Climate Change Convention within its region. Instead, ASEAN has tended to adopt soft law instruments rather than hard law measures to address transboundary atmospheric pollution, particularly that resulting from forest and land fires.
