Land, Property, and Good Governance
In the book land, property and governance, we look at the use of law in anticipation of a deadlock because contracs cannot be executed. For example, housing contracts for low income people cannot be completed due to the Covid-19 pademic. We will discuss the legal comparison between before majeure, default, and rebus sic stantibus. The agreement assigns the duties, responsibilities, and obligations of the developer, vendor, and buyer and provides recovery to the contracting parties. In this book, we discuss cases of recovery for complains from the parties and fins that the buyer of the victim who suffered a loss has the right to specific legal and justice remedies. In Malaysia’s case, legal provisions are the main factor restricting the growth of Malay Reserve Land. Other non-legal factors also relate to the debt burden and the need for cooperation between co-owners. In addition, development planning guided by ecological governance is the best development framework beneficial to present and future generations. Land can also be a source of conflict. The book also looks at land tenure conflicts on plantation and forestry lands occur because indigenous peoples do not have legal certificates of land ownership.
